Can you let a Madrid holiday property by the room?
A VUT in the Community of Madrid is let as a whole: it should not be marketed room by room as though that were the same category. Room letting may fall under other uses or regimes, but needs its own assessment. Using a different contract or advertising a longer stay is not enough.
What letting the entire property means
A holiday property and individually rented bedrooms are not legally interchangeable products. Having several bedrooms does not authorise you to operate them independently under a registration intended for the whole home.
Madrid’s VUT regulations are based on letting the whole property. The regional update in 2026 also requires a review of technical requirements and their application, rather than copying an old checklist.
Tourist, temporary and residential: start with the actual use
A stay by someone needing accommodation for study or work is not classified simply by counting months. Its reason and actual use must be assessed. It is also necessary to distinguish room letting, letting an entire home and operating a lodging business.
Consult the Urban Leases Act and seek advice on the specific arrangement. The application of the LAU or other contractual rules should not be assumed automatically for all room rentals.
What to check before advertising
- Municipal use: which activities the property permits and the conditions for establishing them.
- Regional classification: whether the proposed operation falls within a regulated category and its requirements.
- Owners’ community: applicable statutes, resolutions and authorisations.
- Technical conditions: capacity, spaces, installations and safety for the actual use.
- Operations and contracts: services, support, duration, price and each party’s obligations.
An example to avoid confusion
If a property is advertised as an entire VUT for a single booking, do not assume that the same classification allows you to sell three bedrooms simultaneously through three separate bookings. Before advertising it, establish whether that second project is permissible and under which conditions.
Similarly, calling each room “temporary accommodation” does not, by itself, resolve an activity that is actually operated differently. Advertising and operations must be consistent with the model that is genuinely authorised or permitted.
How to move forward with your property
Prepare the address, floor plan, proposed capacity, services you want to provide and existing documents. With this information, a technician and adviser can assess suitability without relying on generalisations. A management proposal should start from that feasibility assessment.

Two projects that should not be confused
A property divided into independent bookings
Before offering each bedroom separately, describe capacity, access, shared areas, frequency of stays and services. This project may have different planning and classification requirements from an entire VUT. A number granted for another category does not establish approval of the new operation.
A room in the home where the owner lives
Sharing a kitchen or bathroom with the owner does not, by itself, determine the legal regime. The actual use, purpose of the stay, services, advertising and applicable regulations must be assessed. Explain which spaces are private or shared and the terms offered, without promising a general exemption because the owner lives there.
Documentation and services: separate responsibilities
A technical proposal should state what it checks about the property and what remains pending with the authorities. A management proposal should specify who supports occupants, cleans shared spaces, maintains access arrangements and resolves incidents. Separate the commercial conditions of each booking from the requirements for operating the activity.
The LAU changed in October 2026: review its current wording and transitional rules before reusing older room or seasonal rental contracts. The national law’s categories and the autonomous community’s tourism categories must be considered together.
