Holiday properties in Madrid: current requirements and procedures

In Holiday rental regulations and taxes

Opening a holiday property in Madrid requires checking several layers of requirements. A regional declaration, a technical certificate and planning compatibility each serve different purposes. None should be presented as an authorisation that automatically resolves everything else.

1. Municipal use and feasibility

Start with the property’s address and characteristics. Check the planning framework and procedures for the intended use, including the building’s history. In Madrid city, Plan RESIDE forms part of the framework a technician must review. Requirements may vary between municipalities within the autonomous community.

Do not copy a neighbour’s solution or assume that existing advertisements prove that property complies. If you are buying or renovating, make this check before committing substantial expenditure.

2. The owners’ community

Review the statutes, resolutions and approvals required for the activity and its start date. The 2025 Horizontal Property Act reform requires consideration of prior approval in the circumstances it regulates, taking account of transitional provisions. The absence of a prohibition does not, by itself, complete the assessment.

3. Regional tourism requirements

The Community of Madrid regulates VUT conditions. Decree 27/2026 amended Decree 79/2014, so the project must be checked against the applicable wording and transitional arrangements. Capacity, equipment and documents should not be verified using an unreviewed old checklist.

The CIVUT certifies technical aspects within its remit. It is not a municipal licence and does not allow planning feasibility to be ignored. Ask its preparer for the exact scope of the work and the documents required.

4. Distinguish each document

What to clarify in the application file
Item Question for the professional
Municipal compatibility and procedure What use does the property permit and what action is required?
Technical certification Which requirements are checked, under which rules?
Tourism declaration or registration What documents and obligations does it involve?
Owners’ community Which resolutions or approvals are needed?

Do not include documents in a current checklist when the text itself identifies them as abolished. Ask for a dated checklist referring to the property and selected category.

5. Budget for the complete process

An administrative procedure having no fee does not mean the entire compliance process is free. Technical work, property adaptations, certificates and other costs may be involved. Request an itemised quotation separating procedures, building works and launch costs.

6. Prepare the operating obligations

Beyond the initial file, organise suitable insurance, guest information, cleaning, support and maintenance. Review guest registration and financial documentation. The listing must match the capacity, equipment and services actually available.

The national rental registration framework has been the subject of judgments in 2026. Check its status when advertising the property; do not copy 2025 instructions without checking their validity or interpret these changes as removing every obligation.

To proceed, gather a floor plan, existing documents, the activity’s history and the proposed operating model. This information enables a specific review and avoids basing an investment on a generic answer.

If you will manage the property remotely

Appoint someone responsible for official requests, changes to the file and incidents. Online rental marketing and on-site operations are different scopes: agree who provides access, arranges cleaning, maintains equipment and responds to emergencies.

Before signing, request a proposal separating technical procedures, marketing and day-to-day service. If works or another check are needed, confirm who will commission them and how the cost will be approved. Delegating operations does not remove the need to understand which use is viable.

If the property was already operating as accommodation

Review its history and current documents before assuming an earlier position covers any change. Increased capacity, another marketing approach or physical alterations may require a specific assessment. Keep copies of the file and relevant communications.

Assess your Madrid accommodation’s feasibility.
