Form 179: why it was abolished and what to check now
Form 179 has been abolished for the 2024 tax year onwards. Do not follow filing instructions from an old guide as though they were a current obligation. The Spanish Tax Agency retains historical information for earlier years, which is a separate matter.
What Form 179 was used for
It was an information return concerning the letting of homes for tourist purposes. Its purpose was to provide information to the tax authorities; it did not replace the owner’s income declaration or, by itself, make an operation lawful under tourism or planning rules.
The original article explained the obligations and deadlines for that form. This URL is retained to answer questions its name still raises, but registration and filing instructions that no longer apply to current years have been removed.
How it relates to Form 238 and DAC7
The AEAT explains that property rental information now falls within the reporting framework for platform operators. The party filing the information return must be distinguished from the party providing information to the operator. This does not mean that every property owner must file Form 238 because they let a home.
If a platform requests identification or property details, verify that the request comes through its official channel and which information is needed. Listing on several platforms may result in several data requests; keep the information consistent and review communications received.
What remains the owner’s responsibility
Abolishing an information return does not remove the obligation to declare the relevant income. Tax treatment depends on the taxpayer, activity and services provided. Nor does it replace tourism, municipal or guest registration requirements that may apply.
- Keep bookings, platform statements and direct payment records.
- Gather invoices and supporting evidence for business expenses.
- Check account holders, tax addresses and details reported to channels.
- Provide your adviser with information from every channel and period.
- If you receive a request concerning an earlier year, check the period and content before responding.
If you are looking for an older return
Use AEAT guidance for the relevant year. A historical enquiry or correction should not be confused with filing an abolished form for a new year. If you act as an intermediary or operator, assess the obligations arising from that role, not only those of an owner.
To organise income and expenses, see how to declare holiday let income. To understand information requested by platforms, read our DAC7 guide.
How to organise an enquiry about earlier tax years
Identify the year, your role in the transaction and the document you wish to review. Being an owner, acting as an intermediary and managing a platform account are different roles. Also establish whether you want information, to correct a previously filed return or to respond to a specific request.
Gather property identification, ownership and letting party details, dates, amounts and supporting documents. These help reconstruct transactions but are not a universal list of fields currently required by the old form. If a report contains errors, identify which entity submitted it before requesting a correction.
Reported information and the tax calculation
An information return reports data; it does not itself calculate the owner’s tax. A platform’s reporting of a transaction also does not establish that your income tax return is complete. Reconcile gross amounts, commissions, refunds and transfers to avoid omissions or duplicates.
